To say some BS about the fact that your brand was on the cattle and tried to take them out of my yards, you'd get the business end of a shotgun to argue with.
Or, I could simply put my brand on them, and according to your theory, they're now my cattle. Yes, brands are identifying marks, but they're not what they once were.
