Wisconsin | The tile was already paid for by both parties at the time. As long as he's not changing the direction the water flows, then at most he's putting more water in the tile vs surface runoff and at different times than without the additional tile. That's one way to see it, and harder to say he's harming the downstream neighbor. Since he's in NE Iowa, I'll guess he's not dealing with land not having an outlet otherwise, or long term high water table like could happen in ND or other parts. | |
