Conger, MN | I'd disagree with the one comment that nothing legally is needed . . .
Unless -- back in the 1970's -- the agreement was that both parties could add on as they wished without notifying the other party, then neither party should add to the system without the other's consent. Maybe it was a "no harm - no foul" situation when you added on before . . . . However, that does not change the fact permission to modify/expand what is being discharged into the system should be obtained.
If an additional 5% was added to the amount put through the system, it is probably no big deal. There could be situations though where the system's capacity would be exceeded by adding acres -- say a 30% increase. then, what if the other guy wants to add more acres a year or two down the road?
It would be a good time to sit down to discuss changes . . . and have an agreement that would cover not just now, but for years into the future.
