Subject: Land rent problem.


We just rented a farm by sealed bids. The contract includes a "Fertility to be the same at the end of the lease". I have no problem with that. It is the way it should be.

Here is the problem. The soil test was pulled just after corn harvest. Then the guy farming it cut all the corn stalks off after the bid opening. Landowner had no idea he was going to cut the stalks. I have no idea what his end date was but I would guess after the bid I would look at it as not my ground anymore when the crop was harvested.

So the questions are:

How many pounds of plant food did I just lose?

Did the residue belong to him or the landowner?

To all the landowners out there: Write everything down on paper. Leave nothing to discuss later.
