Generally, you can cut anything hanging over your side, as long as you don't take too much, but try to get him to fight that away from a yard tree. Tordon would be an easier win for him, unless it were to happen randomly over the course of many years, harder to prove the relationship that way...

Drainage law varies by state, and enforcement varies hugely by county or township. You don't need the enforcement if you're willing to do the work, and let him try to stop you, assuming you know you're within the law.
