X2 on getting the drainage district to be the bad guy, if it is in one.
What I perceive his problem is is that the boundary may not be specified very well.
I have a property that the deed states to the middle of the ditch.
This deed was written when the ditch was probably the width of the water ( 2ft or less) and followed a pretty defined path. When they channeled the river, the ditch got 50 ft deeper and 200 ft wider, over time. Then a tube was put in a road downstream and started causing silt to be deposited.. Now the creek tends to move around. Terraces above the creek put water underground. This causes more bank erosion on one side than the other.
It is not a problem so far, as I have good neighbors, and so far, the only reason to worry is if the trees that were sold came off my side or his. This was easy to resolve as they were the logger so my percent is not that big a deal, plus they go to great extremes to be honest.
What will happen when the next owner wants to build a lake to make their new housing development go better?
