get out in front of it before it eventually becomes a mess. Very kindly and politely tell him that you wish he would cut the trees but it is his right not to but that you will be cutting any branches that are on your property. You own the space above your ground (there are limits but you do own it). Should be a very non confrontational conversation.

edit to say that if he does not agree with you owning the space above your ground and that the entire tree is his that you will be sending him a bill for any damage "his tree" causes you in the future. If it comes to this have your conversation via text or email so you can have a hard copy documenting that he refused to keep the tree trimmed.
