Those of us saying it's kinda common to do fall tillage - return the ground to the condition you got it - are from Minnesota. That would be a standard practice 'here' so the fella you are dealing with might well consider that to just be normal farming practice.
It appears it is different in other parts of the country. Might explain a bit of the issue.
