NW IA/ SW MN | I agree that the issue is not the cornstalks...it's the fact that someone was on the land before Dec 1 WITHOUT permission. Another thing has been overlooked too. Sure the landowner hinted that his son may want to farm, but why didn't he tell his tenant what his decision was? I would think the tenant deserved to be told what was happening by the landlord either in person or with a registered letter.
If I rented the farm I would be happy with the fact that I have it rented and stay out until after dec 1. On the other hand, if I'm losing the farm and the new tenant asks to disk the stalks I would probably say go ahead depending on the situation. Around here we have guys who try to rent ground out from under the exsisting tenant and if that was the case then I'd tell him to keep his can out until dec 1 or ask him what it's worth to him. | |
