Jim, Just to clarify to make sure I understand your situation, you currently have a boundary fence that is known to be off the legal line, you've left the fence there and still using it but had it surveyed to show the proper location of boundary line? If this is correct, did you record and notate that in county recorder's office? After certain period of years ( I know but not going to say as it will spark another page long thread, I feel bad in calling out Kooiker in a hypothetical fence circumstance the other day in attempting to get him to think about it differently and look at what that caused!) that fence line will be considered the boundary fence line surveyed or not UNLESS it is recorded and agreed upon. I just didn't want you to think you had the satisfaction of knowing where it really belongs because of being surveyed........your neighbor can still be a butt head and claim your 5' someday unless you get the paper work done properly. If I mis understood the circumstances I apologize.
Over my 27 yrs of commercial fence building that is the worst mediator position I was caught in a lot: Farmer and new neighbor that just bought the adjoining ground decide lets put in new fence, great. Since I just bought this and a survey was required it's going to be easy for you to know where to start and stop, just go to the pins! But the pins are 3 -10' away from where the old fence was and the farmer knows........and old corner posts prove it. Then a nice new fence gesture becomes a ugly neighbor dispute with me in middle trying to defuse. That part of the business I do not miss one bit, just look at that fencing thread...proof of concept! They aren't discussing what the law says but the Law has to be wrong?? Wonder if I can get as long of thread discussing if Speed Limit Laws are wrong too OR why can't I pack my loaded pistol (that I have concealed weapon permit for) while I'm sitting in on jury duty?? The goofy law must be wrong?
