SE Indiana | Do not sign anything until you have legal representation. Find a good attorney that specializes in these easement issues. Right down every conceivable concern you can think of (you will miss many issues). In any contract make sure it affects “all land” in the easement, not just “ag land”. Otherwise they will only be concerned about crop production land. Remember this easement is potentially for EVER, no trees buildings, or many other uses. Regardless of what the land agent tells you they will not leave the land nearly as good as it was before. Our yield monitor showed a 10-20 bushel loss on the 150’ where the installation occurred on our land this year. Which happened nearly 10 years ago. We also had to do major corrective practices to restore the surface drainage across the ROW area. We have 2 other lines installed in the 40s they still show up in the crops. Your land will be permanently damaged. When installation starts inspect the operation at least daily, report any deviation from the prescribed practices in the contract to your attorney immediately! Have him insist that construction be stopped until it is corrected. DO NOT a try to be cooperative or helpful to the contractor or the pipeline.
Better yet tell them to move it someplace else if you can. | |
