I have to admit the idea of worrying about someone later getting free use of a fence built by me for my own purposes was difficult to get my head around.   That seems about as bizzar as wanting protection against water running uphill around here.  Still, having that protection in the fence law seems fair enough it needed in your neck of the woods.
