Put up a single smooth wire and some T-posts, wherever you want, even 16 feet on his side, and turn out the cows. See if the law matters all of a sudden.
You both have a right to use your own land as you see fit. You both own a boundary that needs protection. The point of the law is that both parties agree to maintain an agreed boundary to the highest need necessary. If you aren't willing to fulfill all of it, why bother with any of it? Much of the time "horse high and hog tight" won't be an issue, but when it is, the shared boundary should be properly maintained. | |
