CENTRAL ILLINIOS | I was on the board of a grain elevator back during the flood of 1993. We were shipping single cars of corn to the southwest chicken market at that time and a few cars got stranded on a siding when a bridge washed out. They showed up at their destination after sitting in the hot sun for several weeks, out of condition and rejected by the buyer. The Railroad claimed the "act of God defense" and refused to pay damages until it was proven that they did move some (higher priorty) cars past that bottleneck so in the end they had to pay damages. | |
