I'm not informed well enough to answer the firat part of your question another than to say you need to talk to someone that has the legal expertise in that field. As for the second part of your post as to where to file & why some charge sales tax & some do. My wife runs a business & sells in two states. She has to file sales tax in the state that the item is sold in, not where we live. As for the sales tax itself, it can be eother included in the price of the item or charged seperately, at least in the staes she deals in, but you will have to pay the correct amount of sales tax. Example she could sell an item for $10 and if the sales tax was 5% add 50¢ sales tax or sell it for $10.50 with no sales tax but when it came time to file the tax she would pay 50¢ sales tax to the state on both sales.
