Nw iowa | Tile that comes from field hooks to tile that crosses ditch and goes under highway then it turns about 90 degrees and stays under road til it outlet in another tile that crossed the road. The connection is under the road. Tile is plugged or something because water is boiling up in ditch but not well. So it’s mostly not draining. Dept in charge of that right of way says it’s my problem. Talked to a contractor he says it in right of way so they’re problem. He said read the iowa code. The code reads if tile crossed right of way it’s up to who right of ways problem. But if tile runs parallel then it’s not clear. If damaged due to road redo then there’s. If it drain district and normal degrade. It’s the district but this is not in district. Then private could be cost sharers but isn’t clear. Does anyone know? Thanks | |
