Here in Iowa, you can trim branches that overhang the fence, but you can't reach over the imaginary line straight up form the fence to trim. You also can't damage the tree, so I don't see how taking an excavator and ripping the branches off would work. But I guess that's between lawyers if the neighbor pursues it.
I trim branches from neighbor's cedar shelterbelt trees that hang over our fences, and throw them back over the fence, under and around his trees. I have called a few times and asked permission to go in and cut out some of the mulberry trees and treat the stumps, which he said yes, and thanked me for cutting them out.
