Near-north Ontario, French River | I re-did my will a couple years back. The way the lawyer explained to me.. if I left you a policy with only your name on it, the money would go to you exclusively so it would be shielded in a divorce. Now there were some caveats, for example if you simply put the money into a joint account with your wife, or pruchase a home with it, then it becomes jointly 'owned' and your wife would get her 50%. But if you invested it solely in your name it would remain shielded. Same with beneficiaries in the will. If I give money to a friend, but was concerned about a divorce, I would name John Doe in the will not John and Mary Doe . Now I'm sure if enough money is involved ( like in the OP's case there is farm land involved) anyone left out of the will could probably find the right lawyer to argue the will. at that point all bets are off. |
