Cut it off above the fence along with all of the limbs drill a few holes in the trunk and put roundup in the holes. The trunk will go to sleep and not wake up. Might have to wait till spring to treat it with roundup. You could use Tordon but Tordon goes down to the roots which is good for the kill but Tordon stays active in the soil for several years and could stunt or kill the new ornamental tree if it is planted close to the treated stump. Another method that involves a ton of work is dig down and cut the tree off below the fence. Cut the fence on both sides of the tree and splice the fence back together. I actually did that once years ago when I had more brawn than brains. You will still need to treat the stump. And you will have a happy wife. Happy wife, happy life.
