I'll say the short answer is "yes", just like a photo airplane or satellite, or Google Map vehicle (the one with all the cameras & gps equipment) can. Setting foot on "your property" is different than flying over...in anything. The air above your ground is CONTROLLED (not owned...no one owns it) by the FAA, to some degree, depending on where you live and what starting altitude above the ground.
Again, I personally do not think it's prudent to become a nuisance with drones, planes, or cars. Not sure what to do about the satellites....doubt anyone will respond or listen to any criticisms of their photo taking.
Most drone publications, including OM's included in drone kits suggest not flying where you're invading other's rights to seclusion.
