No way I'd put a mismatched ring and pinion together. There's zero reason to, and a long list of why not to.
I've never seen a bottom shaft seizure from normal operation. It's submerged in oil so it sounds kinda fishy. Must be a backstory to this. Relatively common the top shaft (above oil) welds itself during towing.
