You mean become the IRS? There is a priority, I don't know all the details. Payroll is somewhere near the top of the list that will get paid. Grain and livestock are separately regulated so they will usually get a priority.

Fraud is not covered by bankruptcy. But if they took the payment, and their normal business was to put that money into the general fund, then the general fund paid payroll five months ago, then there's no fraud, just poor management. If by some miracle, they ordered YOUR material, or have YOUR material in their yard, then you might have a chance to recover it. Most likely the money was spent before you paid it, and not for your material.
