I am in the process of eviction of a renter. 5 months back rent owed plus many legal bills from this whole mess. have anyone had much luck trying to have the lawyer try to recoup the damages or is it more $ in their pocket.
Depending on how big the claim is, your situation is what the small claims courts are for. More relaxed, basically just regular people in front of the judge, not lawyers.

It sounds like you already have lawyers involved for the eviction, having them continue on may not be that expensive, they will already be familiar with the facts. May be best to discuss it with them. You may also want to consider the fact you may win the judgement and never collect on it. You can garnish wages, and file liens, but those don't work well if somebody doesn't work and has no assets.
Lots of people use the cost/benefit thinking when it comes to legal stuff. I don't. We have a few hundred tenants, we try to work things out tremendously, but sometimes you cross the bridge and then it's about the principle and all gloves are off. That's your call.
