Usually the party that has something to gain requests the survey.



I think adverse possession trumps a survey otherwise therefore wouldn't be such a thing as adverse possession. I have .5-1 acre piece that didn't exist until the county straightened a creek in the 60s. The neighbor tried to take it, but was unsuccessful.

Edited to add as someone else said find an attorney that knows about adverse possession. My general practice attorney charged $1000 to do research into it, research that took me 15 minutes on the Internet to find the same information.
