You cannot legislate morality.
There are basically 2 kinds of laws:
Traffic laws, like "drive on the right side of the road." The existence of the law is important, but the law could say something else without a problem.
Moral laws, like "don't kill people." Both the existence of the law and the content of the law are important. You absolutely can and must legislate morality, what you cannot legislate
(in a modern secular state
) is theology.
