Subject: Lets talk about the most ambiguous government program ever

So a lot of farmers last week got letters announcing a Emergency Relief Program. They listed an amount of money you may be eligible to receive because RMA records indicate you have received a crop insurance indemnity for the 2020, 2021 or 2022 crop year for an insured cause of loss that occurred in calendar year 2020 and/or 2021. The letter further states "you MAY be eligible for additional benefits under the recently announced ERP program."

It is based upon the entry under "cause of damage" heading. 

Drought in this box doesn't qualify for a payment if it wasn't in a county that was qualified as a "qualifying drought". A qualifying drought is defined as  either a D2 (severe drought) for a period of time not less than eight consecutive weeks or a D3 (extreme drought) or higher for any period of time during the applicable calendar years. 

Another cause of damage is excessive moisture. Last year was probably the highest amount of replant of both corn and soybeans this area has ever experienced. 

Now the quandary. On acres that had excessive moisture that resulting in replanting that later were affected by dry conditions is there a legitimate claim? Remember the dry weather isn't a qualifying event if it wasn't a D2 or D3 event. Can the argument be made successfully that the wet weather which necessitated replanting pushed the reproductive phase of the plants back enough that the dry weather affected the crop whereas if replanting hadn't been necessary the crop would have been through the reproductive phase before the dry weather affected it?
