Work with a lawyer, family can be fickle. You need to protect yourself with thinking you have this sewed up.
Dont be afraid to bring the seller into the office, so they hear the "law".
It may mean that it wont be for sale for another few years, or it may mean you and the seller get what you both want. But you both need to do it RIGHT.
