I think this is the portion that you are referring to:

Requirement to Purchase Crop Insurance or NAP Coverage: All producers who receive ERP Phase 1 payments must purchase crop insurance, or NAP coverage where crop insurance is not available, in the next two available crop years as determined by the Secretary. Purchased coverage must be at 60/100 level of coverage or higher for insured crops, or at the catastrophic coverage level or higher for NAP crops.

It is not real clear from the above, but I would assume that the rule only applies if you are crop farming in 2022 and 2023. If you are not farming, you cannot purchase crop insurance and therefore the rule would not apply to you. You should still be able to receive the payment, but check with your FSA office to verify.
