Subject: Question about Liability..A truck. A drive over pit with damage.



Kansas
A farmer owned truck going over a drive over conveyer belt dump pit of a commercial elevator. The belted dump pit has fold down sides that you crank up after the hopper is positioned over the top of the conveyer belt so the grain doesn't spill out to the sides.

Somehow the truck caught one of the "flip up sides" and caused the other "flip up side" to raise and dented the bottom of both of the semi's aluminum fuel tanks. When I say dent. This ole boy has about 8" flat spots in his fuel tanks now dented up about 8" from where the bottom originally was when the tank was round.

Who's liable? Elevators flip up side sustained no damage to speak of. Just scratched the paint and put a lil ding in the flat steel.

Is there any liability?

I'm not sure who if anyone is... thats why throwing this question out.
