That brings up another issue that often gets brought up- here anyway.

About once a year, someone will get in trouble because they've fenced or posted land within a county road ROW. State legislature gave the counties in Michigan ROW for infrastructure a very long time ago. The ROW is still in effect, even if a road was never built. It can be abandoned and reverts back to private land, but its a long process that has to go in front of at least two boards. More than that if it accesses water.

Had a guy try to claim adverse possession on a unimproved road ROW one time. Hired a lawyer and everything. Neither the land owner or the lawyer knew that you can't claim adverse possession on public land or ROW. I think the lawyer was real proud of his knowledge right up until that got brought up.

Conversely, the State of Michigan re surveyed a bunch of land in the UP. Lots of property lines got moved, and some lost a lot of land and buildings. Its been in courts since the late 1960's, and the cases will outlive the people suing the state. Hard to fight them even when it appears that they're wrong.
