But , the DOJ has been ordered to dismiss all pending cases, so I kind of fall into both camps at this point. Do I still have a felony?
That was removed when the original "conviction" was vacated, at that time the gov still wanted to re-try me (3rd time) for a felony.
That is "still pending" maybe scheduled for March sometime. However, Trump has ordered the DOJ to dismiss all pending cases....................................With a pardon, the felony still exists on record, but no ramifications are tied to it.
With a dismissal, everything goes away, no "record".
So, yeah, either way it's over.
Not a lawyer, but you say your case was vacated. That felony was removed when it was vacated? If so, it's gone, right? Or just no sentence for it? Retrial is still pending? Trump has ordered dismissal of all pending? No need to answer, but it seems that there is nothing following you. Like I said, I'm not a lawyer.
