I think the first posters are correct. The marriage license seals the deal and the survivor is responsible for all legal debts.

In nursing home situations when the person in the home can't pay and they have to go on Medicaid they will allow the surviving spouse to keep their house if the own one, but if the spouse dies the state gets the house too.

Probate court sorts out these issues. And you better have a good legal will or it gets more complicated.
