Looking for opinions/information here. My son in law is in the Army Reserves. Has served for probably close to 15 years I believe. Well his employer where he has worked for around 7 years has always been very gracious and allowed him paid time off when he needed to report for weekend drill or the annual two weeks training. He had a salaried position. Well they are moving back closer to home and his job was requiring a one hour drive each way. So we were all elated when he found a salaried position at a smaller company 10 minutes from their new home. I guess in the interview process he never inquired how they handled his time away for the reserve duties. But on his second day at the new company, he was informed that all time spent with reserves will be deducted from his 3 weeks a year vacation time. My daughter is upset as this will essentially only give him 2 days a year of vacation time to spend with his family. My question here is, can an employer do this? Can they require you to use vacation days when reporting for duty in service of your country? We’re all pretty shocked at this to be honest. Appreciate all thoughts and opinions!!


They are required, by law, to allow you to perform military duties but they are not required to pay you. You can either go without pay for the days you miss or use your PTO but they can't force you to use PTO.
Simple explanation. I believe same laws apply for both guard and reserve. Id think if he talked with his First Shirt, help could easily be obtained.
