Well, "here" open range means you fence the other guy's livestock out of your land. However, to stand up in court or anything else it needs to be a legal lawful fence. I would look to your state statutes for a legal lawful fence. I know a two wire or even an electric fence doesn't meet state standards here. I deal with public lands all around me, I've got to fence them out of me. However, I also run on public lands. We don't run against corn, but plenty of irrigated alfalfa. We can keep them out of it, and our ranges are very dry feed.

Sounds like you two need to get together and have a fencing party. Make it cow tight, spilt costs. Only my opinion again, I feel son is due damage money. However, both parties should build a fence together to meet everyone's needs. If only one or two cows are breaking down fence those cows should be gone.
