Ray,

out of curiosity, do most rail contracts have a force majeure clause in them? I had asked a similar question in regard to grain deliveries, weather, and markets a year ago to a friend of mine with some legal background. He explained to me that if force majeure is not noted in the contract it cannot be called for. That was his explanation of why most grain contracts could not have a force majeure claim.

cold and snow are as much "Acts of God" as rain and drought.
