Subject: Neighbors cows again

Must be that time of year and I missed the first thread on this subject so I'll add another story. Have a neighbor with a bad history of cows always being out, can't fix fence, gets the sheriff called on his cows being in the road, etc. After doing significant damage to my milo, he says he'll turn it into his insurance and have a crop adjuster come out and see how much damage they did. Is this the best option or should I wait until after milo harvest and see how much damage they did based on yield loss compared to the next closest field that they didn't get into? They pretty much destroyed a 250' x250' spot but the whole herd also ran through the field more than once to go back in his pasture to get water and come back again. This was also during a wet spell which tracked things up even more and the roads to get to this field were impassable.
